How We
Can Help
A mortgage payment that no longer fits your budget can put your home at risk. Fazzio Law Offices helps New Jersey homeowners evaluate loan-modification options, organize an application, respond to servicer requests, and coordinate the process with any pending foreclosure case.
What a loan modification can change
A modification changes the terms of an existing mortgage. Depending on the loan and available program, changes may involve the interest rate, repayment term, or treatment of overdue amounts. Approval, payment reductions, and principal forgiveness are not guaranteed. We review the proposed terms against your income, expenses, and long-term goals.
Prepare a complete, consistent application
Requirements vary by servicer and program. Common materials include:
- A hardship explanation and the servicer’s application forms.
- Recent pay statements or documentation of other income.
- Tax returns, bank statements, and information about household expenses.
- Mortgage statements, escrow information, and details of other liens.
- Copies of prior submissions, missing-document notices, and decisions.
Keep copies and proof of delivery. Ask the servicer to identify missing items and confirm when the application is complete. Continue responding to requests for updated financial information.
Timing matters when foreclosure is pending
Submitting an application does not automatically stop a foreclosure or sheriff’s sale. Federal servicing rules provide protections for qualifying applications, but timing, completeness, and exceptions matter. For a covered complete application received more than 37 days before a sale, the servicer generally must evaluate available loss-mitigation options within 30 days. The rule does not require an offer of a particular modification.
See the CFPB’s application guidance and Regulation X, section 1024.41. If a sale is scheduled, contact us promptly about sheriff’s-sale options. Do not assume that negotiations extend a court deadline.
Review denials and proposed terms carefully
A denial should be reviewed for its stated reasons, the information used, and any applicable appeal rights and deadlines. If an offer is made, review trial payments, escrow changes, fees, deferred balances, and the final payment schedule before deciding whether it is workable.
Depending on your circumstances, we can also discuss foreclosure mediation, foreclosure defense, or a short sale.
