How We
Can Help

If you have been served with a foreclosure complaint in New Jersey, the first step is to identify your response deadline and review the lender’s papers. Fazzio Law Offices helps homeowners evaluate defenses, address mortgage-servicing disputes, and pursue practical options for keeping or selling their property.

Respond to the foreclosure complaint promptly

A defendant generally has 35 days after service to file an Answer. Filing an Answer does not guarantee a particular delay or stop a sheriff’s sale. The response must address the allegations and any defenses supported by the documents and facts. Read our guide to answering a foreclosure complaint and the New Jersey Courts’ foreclosure resources.

What we review with you

  • The complaint, summons, service history, and court docket.
  • The note, mortgage, assignments, and the plaintiff’s claimed right to enforce them.
  • Default notices, payment records, escrow charges, and the amount claimed due.
  • Loan-modification submissions, denials, and communications with the servicer.
  • Any judgment, pending motion, or scheduled sale.

Not every servicing dispute is a defense to foreclosure. We assess which issues affect the lender’s case, which require separate action, and which may support a negotiated resolution.

Coordinate litigation with a realistic home-retention plan

Your goals and finances matter. Depending on the circumstances, we can evaluate loan modification, reinstatement, settlement, refinancing, or a short sale. Eligible homeowners may also consider foreclosure mediation. Negotiations do not replace responding to court papers.

If an auction is scheduled, review our sheriff’s-sale assistance and contact the office promptly. Available relief depends on the docket, timing, prior requests, and supporting evidence.

Prepare for your consultation

Gather the complaint, recent mortgage statements, notices, modification correspondence, income information, and any sale notice. Tell us when papers were served and the next scheduled court or sale date.
